Terms & Conditions

1. Definitions

“Advance Purchase Rates” means the rates as specified at clause 3

“Promotional Rates” means the rates as specified at clause 3

“Flexible Rates” means the rates as specified at clause 4

“Booking” means the booking for accommodation, functions and/or any other services or items made with us.

“Company” or “we” means Scarlet Hotel Tredragon Road, Mawgan Porth, Newquay, Cornwall, England, TR8 4DQ. (company number 04749472)

“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.

“Hotel” means Scarlet Hotel.

“Terms” means these terms and conditions.

“Website” means www.scarlethotel.co.uk or any other website owned or operated by us relating to a Hotel from time to time.

“VAT” means value added tax.

All bookings at the Hotel are subject to these Terms.

If your booking includes dinner, a preferred dinner time is allocated automatically, if you have a preference we kindly request you contact the Hotel to confirm. We cannot guarantee a table in the restaurant in the evening for guests on bed and breakfast terms and you should contact the Hotel restaurant direct to make a reservation. Please note that the price being offered currently cannot be guaranteed should you not complete your Booking at this stage. Menus and spa pricing are also subject to change and are provided for indicative purposes only.

All rates featured on the Website or quoted by telephone or otherwise are offered subject to availability and we reserve the right to refuse any booking for good reason.

2. Pricing

Our packages and pricing fluctuate depending on availability and demand at any given time. All prices are subject to change without notice and are subject to availability and are only inclusive of any meals, service or VAT (at the current prevailing rate) if specified in writing.

Your price is guaranteed once you have been given a confirmation number.

All prices will be shown on our Website and quoted by our team in Pounds Sterling. Any payment collected online will be in Pounds Sterling.

3. Advance purchase or Promotional rates

Advance Purchase or Promotional Rates are fully prepaid at time of Booking. Advance Purchase Rates are non-refundable and non-transferable. The credit/debit card used to book the Advance Purchase Rate must be presented to reception on arrival at the Hotel.

4. Best available rates

Our Flexible Rates allow you to alter or cancel your booking. A non-refundable deposit of 25% is required at the time of booking. All cancellations must be confirmed in writing.

5. Availability

During seasonality, Bank holidays, social events, conference and exhibitions certain rates may not be available. Certain dates may be subject to a minimum length of stay. All rates are subject to availability.

6. Cancellations & Amendments

Guest cancellations

All cancellations must be confirmed in writing. If cancelling within 14 days of arrival, your deposit will be forfeited and the full cost will be liable unless we are able to re-let the room. We recommend that you take out suitable travel insurance at the time of booking in case of the eventuality of cancellation.

If you’re cancelling more than 14 days before arrival, your deposit will be forfeited.

Without notification of cancellation, the full amount will be charged.

Please note that seasonal offers or breaks may be subject to different terms and conditions, these are noted on each break. If you have any questions, please contact our reservations team.

Peak and seasonal cancellations

At certain times throughout the year, we may vary our cancellation and deposit policy. The reservations team will inform you of this at the point of booking.

Amendments

Postponements or significant amendments to bookings should be confirmed no later than 14 days prior to arrival. If amendments are made within 14 days of the arrival date, our standard cancellation policy applies unless we are able to re-let the room.

7. Children

The Scarlet is an adult only hotel and we do not accept guests under the age of 18 years old.

10. Car parking

Parking at the hotel is free for hotel guests but is limited. When you arrive please give your registration to our welcome team and our valet are happy to help you find a suitable parking space or park your car for you.

11. Guest behaviour

Guests are requested to conduct themselves appropriately at all times and to comply with Company procedures and/or requests with regard to conduct and respect for the property of the Hotel, its employees and guests and their health and safety.

We reserve the right to refuse accommodation or services or remove you and members of your party from the Hotel if, in our reasonable opinion, we consider this provision to have been breached.

12. Visitors

We welcome guests of residents to use the public areas and gardens, excluding the spa and swimming pool areas unless pre-booked as part of a Spa Day. You are responsible for the behaviour of your guests they will be asked to leave if We deem this as not acceptable. Restrictions may apply during peak times so please ask a member of the team.

13. Damage

We reserve the right and you hereby authorise us to charge your credit or debit card for any damage incurred to your room or the Hotel during your stay (including without limitation specialist cleaning) or for any items that are missing or damaged when you leave.

14. No smoking

Guests are not permitted to smoke in rooms or public areas at the Hotel. Smoking (including the use of electronic vaporisers) in our premises outside of the designated smoking areas will result in a £125 fine to cover deep cleaning.

15. Arrival and departure

Hotel rooms are available from 4pm on the day of arrival. Rooms must be vacated by 11am on the day of departure, unless otherwise sanctioned at the discretion of the Hotel manager. These times may be varied from time to time at the Company’s discretion. In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference and their passport/identity card/driving licence.

16. Meal arrangements

Rates which include breakfast offer an artisan bakery breakfast continental breakfast tea or coffee, unless stated otherwise. Rates which include dinner cover three courses from the dinner menu and must be booked prior to arrival. There is no refund for meals which are not taken by guests and lunch cannot be taken in place of dinner.

17. Health, leisure and wellbeing

Guests staying may use the leisure and spa facilities throughout the duration of their stay. Please check online for the range of facilities at the Hotel. Your use of such facilities is subject to any particular terms and conditions of your booking or enforced by the hotel.

When you make your booking you will be asked to guarantee your booking with a valid debit/credit card if booked on Best Available Rate, or to prepay if booked on our Advance Purchase or Promotional Rates.

We accept Mastercard, Visa and Delta. Unfortunately we do not accept American Express. We accept cash payments at the hotel.

On arrival you will be asked to produce a valid credit card for the Hotel to take pre-authorisation for any extras during your stay. The unused funds are released after checkout.

Prior to your departure from the Hotel you will be required to settle your bill.

19. Spa bookings

We are open to non-hotel guests for spa days only. Single treatments are available for hotel guests only.

Full payment is required on booking. We ask for 48 hours notice to amend or cancel your appointment. With less than 48 hours notice or a no show, the full booking cost is charged. If you do need to move your booking, please let us know as soon as possible.

Payment will be taken from your card on booking – whether that’s through our spa reservations team or online. If you have a gift voucher, please make sure you present it as payment and this will be redeemed against your booking if you cancel or amend within 48 hours.

20. Restaurant bookings

Please book you table online at www.scarlethotel.co.uk. If you are staying at the hotel and have booked a diner inclusive package your table bookings will be made for you. Please confirm any dietary or allergies at the time of booking.

22. Force majeure

The Company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.

23. Limitation of liability

The Hotel shall not, except in respect of death or personal injury caused by the Hotel’s negligence or in circumstances of fraud or fraudulent misrepresentation (or as otherwise provided for in these terms), be liable whether in tort, contract, misrepresentation or otherwise for any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the Hotel, its employees or agents or otherwise) which arise out of or in connection with the provision of the facilities and services under these terms. The Hotel’s total liability in contract, tort, misrepresentation or otherwise arising in connection with the performance or contemplated performance of the services shall be limited to the price paid for those services. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these terms.

The Hotel will not be liable for any failure or delay in providing its facilities or services as a result of events or matters outside its control. This includes (but is not limited to) fire; explosion; storm; flood; Act of God, action by Government or a Governmental agency; shortage of goods or materials; strike or lock-out

24. Governing law and jurisdiction

The Contract and any non-contractual obligations arising in connection with it are governed by English law.

The English courts have exclusive jurisdiction to determine any dispute arising in connection with the Contract, including disputes relating to any non-contractual obligations.

Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the English courts (on the grounds that the English courts are not a convenient forum or otherwise).

25. Website information

While all reasonable efforts have been taken to ensure the accuracy of information on the Websites, the Company does not accept responsibility for errors or omissions and reserve the right to amend, cancel or vary any of the arrangements featured on the Websites without notice.

The content of the Websites is the copyright of the Company, and may not be copied, reproduced, published, distributed or amended for any other purpose without our prior written consent.

Trademarks used on the Websites are the property of the respective owners. Hyperlinks to third party websites are provided for your convenience. We cannot accept responsibility for the content or use of third party sites.

27. Maintenance, facilities, services

As we are open all year round, we may need to carry out necessary maintenance, development or refurbishment work at the hotel. We will endeavour to keep noise and disruption to a minimum and will advise you prior to your arrival should this impact your stay. Our standard cancellation terms will apply.
